GENERAL TERMS AND
CONDITIONS OF USE

PREAMBLE

These General Terms and Conditions govern the use of services provided by GET ALL GROUP LTDA, registered under CNPJ No. 60.542.953/0001-03, the owner of the intellectual property rights to the platform https://www.getallimages.com , which provides digital image licensing services.

By accessing or using the website, the Customer (individual or legal entity) declares full acceptance of these Terms, as well as the attached Privacy Policy. If the Customer disagrees, they must refrain from using the services.

I. ACCEPTANCE AND CONTRACTUAL BINDING

1.1. These Terms constitute an adhesion contract between GET ALL IMAGES and the Customer, in accordance with Article 423 of the Brazilian Civil Code.

1.2. Browsing the Site and contracting services implies tacit acceptance, as per Article 1,134 of the Civil Code.

II. ACCESS AND FUNCTIONALITIES

2.1. GET ALL IMAGES will ensure, within reasonable technical limits, continuous availability of the Site, except for interruptions due to:

(a) Necessary maintenance;
(b) Acts of God or force majeure (Article 393, Civil Code).

III. REGISTRATION AND CUSTOMER ACCOUNT

3.1. Registration requires valid and up-to-date information, under penalty of unilateral termination (Article 9, Law No. 12,965/2014 – Brazilian Civil Rights Framework for the Internet).

3.2. Minors under 18 must provide express consent from legal guardians, as per Article 82 of the Child and Adolescent Statute.

IV. IMAGE LICENSING

4.1. Images are licensed under two models:

Rights-Managed: Restricted use according to contracted parameters (duration, media, etc.);
The Customer is solely responsible for:

(a) Obtaining additional authorizations for **portraits of individuals or protected works (Articles 20 and 24, Law No. 9,610/98).
(b) PRICING AND PAYMENT

V. Prices are set unilaterally by GET ALL IMAGES and may be adjusted without prior notice.

5.1. Financial data is stored in compliance with Brazil’s LGPD (General Data Protection Law, No. 13,709/2018).

5.2. CANCELLATION AND WARRANTIES

VI. The Customer may cancel licenses within 7 (seven) days, as per Article 49 of the Brazilian Consumer Protection Code (CDC).

6.1. In case of defects, GET ALL IMAGES offers:

(a) Full refund, in accordance with Article 18 of the CDC.

VII. Disclaimer of Warranties:

7.1. GET ALL IMAGES is not liable for:

(a) External links;
(b) Misuse of images by the Customer.

7.2. The Customer shall indemnify GET ALL IMAGES for damages resulting from violations of these Terms (Article 389, Civil Code).

VIII. LIABILITIES AND LIMITATIONS

8.1. Content Responsibility:

GET ALL IMAGES acts solely as an intermediary for image distribution, with ownership rights belonging exclusively to contracted photographers.

- The Customer expressly acknowledges and agrees that:

(a) GET ALL IMAGES does not hold copyright over the images, merely licensing them on behalf of photographers (Article 31, Law No. 9,610/98);
(b) There is no employment or partnership between GET ALL IMAGES and photographers, absolving liability for any defects, inaccuracies, or illegal content in images (Article 927, sole paragraph, Civil Code).

8.2. Exclusion of Warranties:

- GET ALL IMAGES does not guarantee or assume responsibility for:

(a) The authenticity, accuracy, or legality of images, which remain the sole responsibility of photographers;
(b) Violations of personality rights (e.g., unauthorized portraits) or third-party intellectual property (e.g., artworks, trademarks) in images;
(c) Damages arising from the Customer’s use of images the Customer must verify suitability for intended use.

8.3. Customer Obligations:

- Before using any image, the Customer must:

(a) Ensure all necessary permissions are obtained (e.g., model releases, private property authorizations);
(b) Bear liability for any misuse, fully indemnifying GET ALL IMAGES (Article 186, Civil Code).

IX. GENERAL PROVISIONS

9.1. Modifications: These Terms may be amended at any time, with updates posted on the Site.

9.2. Jurisdiction: Any disputes shall be resolved in the Central Court of São Paulo/SP, to the exclusion of any other.
